Question: A few years ago our family bought an apartment on credit (At that time we didn’t know that it is prohibited). The loan was fully repaid. This year we want to sell the apartment and perform Hajj on this money. We know that people should perform the Hajj on Halal money only. Will the money from the sale of this apartment Halal? (Anonim)
Assalamu Alaikum Wa Rahmatullahi Wa Barakaatuh
As you have stated in your question, it was incorrect for your family to purchase the apartment on credit with an interest bearing loan. To engage in an interest bearing transaction is a major and grave sin and you and your family should make sincere Taubah for engaging in an interest bearing loan.
Whilst purchasing a home on an interest bearing transaction is a sin, it does not prevent ownership from being established once all payments have been made. Thus, your family did become the rightful owner of the apartment after the payments were complete and this apartment is now permissible for them. Hence, if they sell the apartment, the proceeds from the sale of the apartment will be permissible for them and it will also be permissible to use this money to perform Hajj.
You should know that one of the factors that makes Hajj compulsory on a person is that he/she possesses sufficient funds for Hajj in excess of his/her basic needs. A home is a basic need and if your family does not have a home besides this apartment, it is not necessary for them to sell this apartment in order to perform Hajj. When they have the financial means in excess of their basic necessities to perform Hajj, they should then perform Hajj.
